The case for open computer programs

Abstract: Scientific communication relies on evidence that cannot be entirely included in publications, but the rise of computational science has added a new layer of inaccessibility. Although it is now accepted that data should be made available on request, the current regulations regarding the availability of software are inconsistent. We argue that, with some exceptions, anything less than the release of source programs is intolerable for results that depend on computation. The vagaries of hardware, software and natural language will always ensure that exact reproducibility remains uncertain, but withholding code increases the chances that efforts to reproduce results will fail.

The 11 provosts of universities in the Committee on Institutional Cooperation published a joint statement opposing the Research Works Act (RWA) and in support of the Federal Research Public Access Act (FRPAA). Excerpt: "We are the provosts of 11 large research universities that engage in over $5.6 billion of funded research each year. That research is directed at serving the public good through medical advances, improved defense systems, enhanced agricultural and industrial productivity, technological innovation, and reasoned social policy....While the collective portfolio of federally funded research undertaken by our universities incontrovertibly strengthens our country, the research process itself is strengthened by an academic culture that encourages the free and open exchange of ideas among scholars....Consistent with these deeply held academic norms, we provosts have advocated for taxpayer access to federally-funded research, writing, for example, a 2006 open letter in support of the Federal Research Public Access Act, and supporting this Congressional session’s proposed extension of the legislation (HR 4004/S 2009)....More operationally, our universities have made substantial investments in the development of open institutional repositories, as well as adopting campus guidelines and procedures to ensure compliance with federally mandated requirements that funded research results be made accessible in open access repositories. As stated above, we believe that open access to such federally-funded research reports facilitates scholarly collaboration, accelerates progress, and reinforces our government’s accountability to taxpayers and commitment to promoting an informed citizenry essential to the enduring stability of our democracy. Because of our strong belief in open sharing of information, we were disturbed to see that recently introduced legislation (The Research Works Act, H.R. 3699) called for a rollback of the progress being made toward opening communication channels for sharing publicly funded research findings with the American people. Were this bill to pass, it would reverse a 2008 administrative mandate by the National Institutes of Health that grantees deposit the results of their funded research in a publicly accessible archive, and prohibit other agencies from issuing similar mandates going forward. We believe that this legislation would significantly undermine access to the new ideas that result from government-funded research, access that we encourage to the public at-large, to a worldwide network of leading scholars, and to future generations of scholars who are today’s undergraduate and graduate students. In our view, ratification of the proposed legislation would represent a step backward in the ongoing enlightenment of society through research and education...."

NHMRC has updated its policy on open access to published research, aligning us with the practices of other international health and medical research funders such as the UN National Institutes of Health, the UK Medical Research Council and the Wellcome Trust. From July this year, we will be mandating the deposit of publication outputs arising from NHMRC funded research into an institutional repository within 12 months of publication.

Abstract: Sharing knowledge and research outputs is critical to the progress of science and human development, and a central tenet of academia. The Internet itself is a product of the academic community, and opening access to that community’s most important body of research, doctoral theses, is both a logical and an inevitable development. Progress toward open access to electronic theses has been slow in the UK. Much has been written on the perceived barriers and practical/infrastructural considerations that might explain this, but a comprehensive picture of that progress, and obstacles to it, was lacking. In 2010, a survey of policy and practice in UK HEIs was conducted by UCL (University College London) Library Services (commissioned by the Joint Information Systems Committee, JISC) to address this very issue. Incorporating inputs from 144 institutions currently awarding doctoral degrees, the work provides the first clear and detailed picture of the status of open access to doctoral research in the UK. The mission of the UK Council for Graduate Education (UKCGE) is to promote and support the interests of graduate education, and this it does through dissemination of best practice and intelligence on emergent trends; helping to shape policy and practice for the benefit of the UK HEI sector. This report contributes to that mission by bringing to the membership’s attention the results of this important work by UCL Library Services; a collaboration between UKCGE and the authors of the original work, it sets out the policies and practices that emerged from the survey and also considers what has been learned about the perceived barriers to the implementation of open access to electronic theses. The 2010 survey has enabled, for the first time, a differentiation to be made between barriers that are “real” and those which are unfounded and/or yet to be properly validated. At the same time, the work highlights the progress made in certain critical areas, as well as those that require our greater attention. A positive picture emerges for the UK on the adoption of the electronic thesis, with the majority of HEIs surveyed expected to be providing open access to their theses in five years’ time. A more detailed picture also emerges regarding the primary reasons for requests to restrict access to theses, some of which, notably, apply only to electronic (not print) theses. This has necessarily given rise to new policy developments. There is positive evidence also of collaboration among HEIs to provide an efficient and robust service for accessing electronic theses; pooling their resources and expertise either in the development of their institutional repositories or in operating a joint service. The key driver of open access to electronic theses is the opportunity for UK HEIs to “showcase” their research outputs to the widest possible audience and enhance their impact. There are no reliable means as yet to measure this impact, but there are encouraging early indications that electronic doctoral theses attract significant attention when made openly accessible. Open access to electronic theses may therefore indeed accelerate the sharing of knowledge and the progress of scientific discovery and human development.

"On January 18, 2011, the President issued Executive Order 13563, in which he directed regulatory agencies to base regulations on an “open exchange of information and perspectives” and to promote public participation in Federal rulemaking. The President identified Regulations.gov as the centralized portal for timely public access to regulatory content online. In response to the President’s direction, Regulations.gov has launched a major redesign, including innovative new search tools, social media connections, and better access to regulatory data. The result is a significantly improved website that will help members of the public to engage with agencies and ultimately to improve the content of rules....The initial APIs will enable developers to pull data out of Regulations.gov, and in future releases, the site will include APIs for receiving comment submissions from other sites. With the addition of APIs, other web sites - ranging from other Government sites to industry associations to public interest groups – will now be able to repurpose publicly-available regulatory information on Regulations.gov, and format this information in unique ways such as mobile apps, analytical tools, “widgets” and “mashups.” We don’t know exactly where this will lead us – technological advances are full of surprises – but we are likely to see major improvements in public understanding and participation in rulemaking. Making Federal rulemaking content available for open exchange was a key goal set out by the President in Executive Order 13563, and we eagerly await the use of these new APIs to enhance and transform public participation in the regulatory process...."

FIA will allow internet users to browse freely without any means of censorship, users have the right to free speech and to free knowledge; we govern the content of the internet, governments don't. However enforcements/laws must also be put into place to protect copyrighted content...."
