"The words "science" and "censorship" do not sit easily together. And yet over the past decade, science has come to occupy an increasingly important role in debates over free speech....Not surprisingly there are debates about the proper course of action. Our special issue [of New Scientist] explores two opposing views. Fred Pearce, the leading chronicler of climategate, makes the argument for open access for the benefit of science and public discourse. Michael Halpern of the US Union of Concerned Scientists warns about freedom of information being deployed as a form of harassment....However, even if an exemption is included in the bill, the combination of hackers, leakers and the sheer momentum of the open-access movement is likely to limit its scope, particularly for politically sensitive research. The leak of a further 5000 climategate emails last week is a case in point. So there may be no other choice but to embrace full transparency....Reform that makes it less easy to use the law as a tool of intimidation and that introduces a robust public interest defence will be of critical importance for the future open discussion of issues of scientific concern...."

"The HathiTrust digital repository and the five universities sued by the Authors Guild and others over mass book digitization and alleged copyright infringement have filed a response to the lawsuit. In September the plaintiffs sued the trust and its home institution, the University of Michigan at Ann Arbor, as well as Cornell and Indiana Universities and the Universities of California and of Wisconsin, in federal district court in New York City. At stake is the control of millions of digitized works held by the trust and the universities. In a December 2 filing, the defendants asked that the HathiTrust case be dismissed. They argued that state sovereign immunity bars the plaintiffs from suing the universities. They invoked the First Amendment and several sections of the Copyright Act, saying that their activities are protected under those laws. They said that the trust is a “service” of the University of Michigan and can’t be sued as “a distinct entity.” They also questioned the plaintiffs’ standing and the court’s jurisdiction. The court has set a deadline of May 20, 2012, for the discovery phase to conclude, with trial scheduled for November if the case was not dismissed or settled."

"In 2003, international research, scientific, and cultural institutions issued The Berlin Declaration on Open Access to Knowledge in the Sciences and Humanities promoting the Internet as a medium for disseminating global knowledge. In order to support continued adoption of the principles outlined in the Berlin Declaration, as well to track progress on their implementation, the original 19 signatories agreed to support regular follow-up meetings. During the first four years, the conferences were designed to explore strategies for building Open Access (OA); presentations during the next few years took stock of various efforts within the OA movement. Last year’s conference in China highlighted the need for access to information to build an informed citizenry. Berlin 9 took place on Nov. 9-10, 2011 at the Howard Hughes Medical Institute in Chevy Chase, Md., the first of the annual meetings to take place in North America. The theme of this year’s conference, The Impact of Open Access in Research & Scholarship, drew 260 researchers, research funders, open-access advocates, commercial publishers, and policy makers. Presenters stressed the benefits of putting research “quickly and freely into the hands of scholars, students, innovators, and the general public.” ..."

"The Global Open Access Portal, launched last month by UNESCO (UN Educational, Scientific and Cultural Organization) at its general conference, will provide policymakers with information on the global OA outlook and situations at country level. It will also point to examples of successful OA initiatives. The portal is funded by Colombia, Denmark, Norway and the United States, and will help to fulfil UNESCO's mandate to provide universal access to knowledge, especially scientific research...."

"Earlier this year, France’s Prime Minister Francois Fillion initiated the creation of an Open Data portal in France and today, this site, together with close to 350,000 datasets, is launching. Data.gouv.fr is comparable to similar open data initiatives by the governments of the U.S., Canada and the UK. A lot of the data that is now available through the new site was not easily available to developers before. This includes geocoded information, data about road safety, environmental and epidemiological data and similar location-focused statistics. In addition, the database also includes information about the budgets and expenditures of local governments...."

As such, she is compensated by Wiley for her service and expected to own Wiley stock <http://goo.gl/9hm9a> (p. 49, Section VII)....If Katehi is financially rewarded (through her stock if not her direct compensation) for Wiley's success in the market, then she has a conflict of interest in assessing the university's interest in OA. "Wolters Kluwer Health today announced that it has acquired Medknow PVT Ltd., a leading Scientific, Technical & Medical (STM) journal publishing operation headquartered in Mumbai, India and one of the largest open access publishers in the world. The acquisition expands Wolters Kluwer Health's Medical Research business' presence in key developing markets and supports its strategy to increase locally written content and incorporate more open access platforms into its business model. Terms of the deal were not disclosed....Founded in 1977, Medknow has a strong portfolio of more than 155 journals...."
